NFL’s Latest Idea: PSLs for Supreme Court Hearings

Screen shot 2010-01-14 at 1.00.14 AM.png

I haven’t had anything to say yet about the American Needle v. NFL case, which was argued yesterday at the Supreme Court. If you’re not familiar with the case, there’s good background here and here, and a good summary of yesterday’s arguments here, but the short version is this: The NFL is claiming that it is one business entity, rather than 32 separate franchise entities, and that this exempts the league from the Sherman Antitrust Act.

Strictly speaking, the case is about merchandising, although many analysts have noted that it has huge implications for the league’s labor negotiations with the players’ union. Naturally, I prefer to look at it from a uni-centric perspective.

The way I see it, one reason NFL design is at such a low ebb these days is that the league already acts like a single entity, at least in terms of its properties division, which oversees all the uniforms. Toss in the fact that there’s only one league-wide uni manufacturer, Reebok, and you end up with the corporate-ized blandness we see throughout so much of the league. Do you think fun logos like Pat Patriot, Sir Saint, or sunburst dolphin would ever have seen the light of day if today’s centralized properties division had been running the show back when those marks were designed? No way.

All the major sports leagues have this same problem — the designs flow out of a central office, so there isn’t enough diversity of style and form — but the NFL exhibits a particularly annoying type of corporate arrogance. Stefan Fatsis’s SI.com report on yesterday’s Supreme Court arguments included this remarkable passage:

Levy [the NFL lawyer arguing the case] countered that the NFL teams need to band together in business because they can’t produce the product — the games — on their own, so the [individual team] trademarks have no value on their own, either.

Think about that. According to the NFL, the Dallas Cowboys’ brand identity is literally worthless without the NFL’s sanction. Ditto for the Steelers’ brand identity, and for all the other teams. Okay, maybe it’s true for the Lions, but you get my point.

That argument reminded me of something I wrote back in the fall of 2003, when Uni Watch had just moved to Slate.com. I wrote a column about league logos appearing on uniforms. I concluded the piece with the following paragraph:

[M]ost fans don’t really care about the NBA per se, or about any of the other sports leagues. They care about the Celtics, the Mets, the Canadiens, the 49ers, or whichever other teams they root for. The fan/team dynamic is what drives pro sports, which is why team logos are the only insignia that belong on a uniform. Somehow the league bigwigs have gotten the notion that the league validates the team. Uni Watch hates to break it to them, but it’s the other way around.

Six-plus years later, I stand by those words. Now, if the Supreme Court rules against the NFL, will uniform design suddenly become more decentralized and playful? Almost certainly not. But the case is a glaring symptom of what’s gone wrong in the uniform world.

Meanwhile: New ESPN column today, and I don’t mind saying that it’s a doozy — look here.

Uni Watch News Ticker: Good article about the Cavs’ equipment manager here (thanks, Vince). ”¦ Dying to own one of those orange-striped AFL throwback officiating jerseys? You can bid on one here (with thanks to Eric Stangel). ”¦ Very cool guerilla art project in Colorado, as someone has planted some phony Gatorade bottles with Tiger Woods commentary into Denver stores (big thanks to James T. Huening). ”¦ Two excellent items reprinted from yesterday’s comments: a game-used Oakland Invaders helmet, and check out the texture on these sleeve patches. ”¦ Yesterday I ran a Ticker item about the Yuma Union High School Criminals. Now Jeremy Zeiders reports that Yuma’s basketball and wrestling teams wore prison stripes, at least back in the 1990s. ”¦ Gumball helmet king Bill Jones has been busy on a number of fronts, creating several new sets of helmets (NCAA FBS, FCS, and D2; Federal League baseball; Asian Baseball League) and adding scans of lots of cool old ads to his Flickr feed. It’s pretty amazing stuff — check it out here. ”¦ College hoops query from Tim Groves, who writes: “I was watching the Clemson vs. Duke basketball game on ESPN tonight and noticed a skull-like image inside the half-court D logo on Duke’s court. Unfortunately I have no pictures because I own no DVR. Do you know anything about this or do you know anyone who would?” Anyone..? ”¦ Michigan State has added an “E.P.M.” patch. “It’s for Tom Izzo’s wife’s dad, Efrain Portillo Marinez, who passed recently,” says Jon Beckmann. “The numbers on the warm-up sleeve I have no idea on. I did some really quick research and came up empty-handed.” Anyone know about that? ”¦ New frilly table tennis dress for Naomi Yotsumoto. “Yes, those are roses in her hair,” says Jeremy Brahm. ”¦ Always good to add another Sox in shorts photo to the visual record. Hadn’t seen that one until Dave Soline sent it along. ”¦ Several readers noted that Texas Tech is going TNOB. Turns out they’ve been doing it all season but none of us had noticed until now (screen shot courtesy of Chris Mycoskie). ”¦ Pure gold now available on YouTube: the entire 1962 AFL Championship Game, an all-Texas affair between the Oilers and the Texans. Good luck getting anything done today, Ricko! (Major find by Bill Killick.) … Tired of the Big Ten’s helmet designs? A bunch of proposed makeovers are shown here (with thanks to Dan Wagner).

The numbers on the Michigan State warm-ups — 64 32 16 08 04 — are the rounds of the NCAA tournament. This is part of Nike’s Team Elite branding.

I guess I’ve never seen all of the AFC East’s white helmets in the link before, but I can see why the Jets and Bills changed in the late 70’s / early 80’s.

Do you think the NFL should go back to the system wear 4 or 5 different uniform manufacturers were allowed to outfit teams? I guess it was companies like Nike, Reebok, Puma, Wilson, Starter, Champion, etc.

Would competition for the right to outfit teams, like in college football, push uni design in a better direction than under the current system where one company (Reebok) controls everything)?

BTW, based on yesterday’s oral argument the NFL just hosed itself. Best case for NFL? The Court remands, discovery begins, and the NFL either settles (read: bends over to American Needle–and others, many others) or launches the multi-million dollar litigation counsel referenced (under oath). And any litigation will *not* be a one-off deal–the Sherman Act implications ripple far and wide. And, to be fair to the NFL, the implications extend to the NBA, NHL, NCAA, etc. What’s almost funny is that the NFL got greedy based on the Seventh Circuit decision.

When it comes to football and hockey designs, anything is better than Reebok.

The NFL’s stance in this case reminds me of one of the definitions of a dysfunctional family: the individuals are there to support the unit rather than the unit being there to support the individuals.

I think I agree with Paul on the team vs league debate. But I want to ask each of you a question: What would you do if your favorite NFL dropped down to the UFL, would you still whole-heartedly support them in the obviously inferior league? Or would you look to make new allegiances in the NFL?

I think that’s the basis of the NFL’s argument. That in the current landscape they are essentially the only real game in town. Without the NFL support where would a team turn that would fill a stadium with 80,000 people on a weekly basis? Maybe if we get a secondary league that becomes large enough to actually compete with the NFL will their argument lose all validity.

The update to the Big10/11/12 helmets was pretty good. I think a better make-over for Penn State would be to keep the white helmet and add the profile Nittany Lion logo (link). That may even work with a solid blue helmet also. I’m a Nits fan, and this may be considered heretical thinking, but a little updating would be nice.

So.. I’m probably taking a trip up to northern AZ in a few weeks. Wonder if that Browns cardigan will still be there.. Keith Winney – do you recall the name of the store?

okay here is my two cents towards the topic o the day…

i have always seen the Team to League relationship as kind of a “state to country” relationship. every school room, court room, auditorium, gym, has at the very least the american flag, and sometimes even the state flag as well. i have no problem with the league putting its logo on the apparel of the teams that make it up. its like a stamp of approval almost. if there is one thing i hate, its fake, phony, replica-esque, cheap looking apparel. a little silhouette of jerry west on the shoulder of a jersey is not in bad taste. However, annoying adidas and reebok logos are in very, very, very, very bad taste. The team is called the Pittsburgh Penguins, not the Pittsburgh Reebok Boys. The fact that EVERY NBA team has the same warm ups pisses me off. the NBA has become entirely too “templated”. for those of you dont understand my made up words, what i mean is that the uniforms in the NBA look like they are based on the same template, the only thing that changes are the colors and names. I actually like the fact that there is only one company aloud to outfit the leagues. Just dont whore yourself out on the players themselves. Do it like the MLB. keep it quiet and discreet on the uniforms and whore it out throughout the stadiums and in the media. all in all, you need “the shield” (nfl logo) on every piece of official NFL merch that is for sale to the public. what you dont need is the outfitters’ logo. sorry reebok.

I applaud the effort on the BigTeleven helmets (love the BigTeleven name too). But I don’t think the majority were an improvement. And as a Gopher fan – no way would the cartoon head work. The current helmet is simple and works IMHO. They keep tinkering with the “M” itself from time to time (outline, double outline, no outline) for no apparent or good reason.

The Gopher unis however…different story. Not as bad as the EKG unis from a few years back but what a mess currently.

i enjoyed the big 11 helmet reworks, and a couple might actually work, if you wanted to ruin the tradition involved; good ideas that will never see the playing field…nice thinking outside the box

one question came to mind…if by some chance sconie changed their lid, would they still be able to sue every high school in the country for motion w infringement?

I, too, like the fact that MLB caps since the early 1990s have had the logo imprinted on the back. As you note, it does give a sort of stamp of approval to the merchandise being sold.

i need some EMBROIDERED PATCHES made for a project i’m working on, but don’t want to pay an arm & a leg! can anyone out there help me please? anyone know of a good company? anybody own a machine? i’ll do 50 patches if need be! thanks!

As someone who has gone to Baltimore CFL and Baltimore JV Areana League games I would go with my City! I know what it’s like to have no football, so I will support my local team if that’s what I have to do to see football.

I’ll still watch NFL on TV, but I doubt I would go to games or buy generic NFL merch.

    on the BigTeleven “makeover”

leave it to a michigan fan to try and makeover the big ten unis. The BigTen has one of the best sets of uni’s (as a whole) in the nation. 2nd to only the SEC probably. Those helmets were simply awful. It screams of cheap high school uniforms. Since i have free time, (and im so sure that all of you care) ill give you my rundown on each team:
Illinois- dont mind it. keep the orange lid with the circle illini logo.
Northwestern- like the grey lid. put the Wildcat N on there and lose the words. team names do not belong on helmets unless part of the overall design. (i.e.- Steelers, Raiders, Jets)
Wisconsin- are you crazy? why would u change the W’s unis?
MSU- they change every year anyway but this is just awful.
Minnesota- UMs helmet is classic. old school M, no stripe, no cartoons.
Purdue- not bad for Purdont. like the logo, keep the current colors though
Indiana- actually not bad. IU will never be a football school. so not bad. i dont mind these.
Iowa- are you insane? Iowas uni’s are almost identical to those of the steel curtain steelers? why would mess with that?
Penn State- how dare you change the classic set that is happy valley
Michigan- even though i hate the school and the entire state for that matter (go bucks) i LOVE their uni’s. let me rephrase that. i loveD their unis back when Nike made them. adidas has added way too many stupid ass stripes.
Ohio State- yea we dont even need to talk about this. OSUs will never wear red lids again. i know they did with woody but guess what, they dont now. silver domes, green pot stickers. that is ohio state lol. as soon as they go back to the 2002 era unis, everything will be fine.

    there im done. :)

Without a league, there are no teams. Without the NFL, the Pittsburgh Steelers don\’t exist. If the Pittsburgh Steelers logos, uniforms, etc. moved to the UFL, do you really think most of their fans would follow?

Yes, I think Steelers fans would follow their team, wherever they went. We’re talking about the die-hards. And that’s probably 80% of their fanbase. The bandwagon people, who only follow them b/c they have to root for a team that’s always good . . . they’d move on to some other bandwagon.

I’m not from Pittsburgh, but it seems to me those people are pretty serious about their Stillers.

oh yeah! much like packers fans, we’d follow our team anywhere! lol. but why does it have to be the UFL? what if the CFL branched out and adopted the steelers and packers?

I do think that it is nice to see some consistency when it comes to team uniforms in the same league. I am not sure that this means that all uniforms should be produced by the same manufacturer, but some consistent design elements are a good feature.

I don’t think that this would translate to the NFL, but I tend to think that the English Premier League Football (soccer here state-side) has a nice protocol. The teams can use any manufacturer they want, use any color-scheme or kit design. The one design element that ties it together is the NOB, and number font. They even feature the league’s crest in the jersey numbers. I have always though that this made that entire league look like pure class.

Of course there are other league-wide restrictions and kit design rules, but for the most part the uniforms look completely different, but tend to really work well together.

That Tiger Woods Gatorade thing reminds me of how I used to bust the manager’s balls years ago as a signpainter in a sign shop. One time he leased a Coke machine for the shop (after a bimbo saleswoman practically parked her breasts on his desk) and I took some red and white paint and changed “Coke” to “Puke”.

Another time I took his container of Slim Fast diet powder and repainted it to say “Stay Fat.” Yes, I spent a lot of time with Wacky Packages as a kid….

I think the Steelers brand is so strong, that it would validate any league that they moved to. If for some strange reason the Steelers left for the CFL, the CFL would become a MUCH bigger deal to American sports fans . . . and ESPN. The same could be said for the Cowboys, Patriots, Peyton Manning’s Colts, and any team Brett Favre plays for.

I actually have the DVD of that ’62 AFL Championship Game. It’s epic. Curt Gowdy on the call. Jack Buck on the sidelines. There’s a classic moment at halftime where Commissioner Joe Foss honors the players of the year and Len Dawson has to be out there on the field to receive a car or something – at halftime of the championship game of the league!

Packers fans? Bad analogy. If the Pack dropped out of the NFL, they’d lose their identity. 90% of being a proud Packers fan lies in declaring how much you hate the Vikings and Bears.

I think that the team vs. league arguement isn’t (as just about everything is these days) a black and white issue. To say the Dallas Cowboys’ brand identity would be worthless without the NFL is absurd. If Jerry Jones got fed up with the NFL and started a new league with the Cowboys as the centerpiece, Dallas fans would follow. Other teams with less of a storied past such as Jacksonville or say the Chicago/St.Louis/Arizona Cardinals most certainly do get a huge assist by being affiliated with the NFL.

Not that this point helps the Supreme Court case in any way…

oh. i just used them as an example because i know their fans travel well…

Paul, I think you’re right in the way an exclusive manufacturer like Reebok affects the uniforms.

Just look at their deal with the NHL. They’ve taken many of the uniforms and made them cookie-cutter (Avs, Panthers, Oilers just to name a few). And it boggles the mind considering the beautiful job they’ve done for teams like the Bruins.

I love soccer and the many different uniforms, but even with the few major manufacturers (especially with the top leagues) they have, those are pretty much cookie cutter as well. Especially when they come out with a new kit every 2 years.

One man’s guerilla art is another man’s federal crime: They’re charging the Gatorade bottle guy with product tampering (even though he did nothing to the product inside the bottle). Charges are introducing a misbranded product into interstate commerce, altering food labels while the product was for sale, and intent to cause serious injury to the business by tainting a consumer product. Charges carry a max 5-year prison term and $450K in fines.

I have no problem with the red helmet, but the wordmark is just another unnecessarily cluttered design.

NFL presenting itself as one entity?

Tough to point their revenue sharing as proof of that when American Needle could introduce all those public statements from Jerry Jones about how it has to stop.

That would seem to indicate separate entities, no?

Aw, hell, I dunno, this subject has been bandied about for a long time.

I do know that during one of the work stoppages, the players staged games of their own (mostly was the Gold team against the White team, as I recall). They were televised, but I think the camera crew outnumbered the paying customers.

Allegiances are to teams, primarily. That’s the bedrock of all pro leagues. And after that comes, yes, “I love NFL football”, etc….but generally the entry point is a team.

“If the Steelers dropped to the UFL…”?
What, we think this in English soccer?
“If an elephant stood on its nose and played ‘Layla’ on the zither…”

Honestly, there are teams that aren’t doing so well in some of the upper-level minor leagues. Abbotsford, the AHL affiliate of the Flames, built a brand-new arena for the team, and is only averaging about 3500 fans per game. For a brand-new team in town, that’s not so good.

However, with the Manitoba Moose visiting Abootsford, BC this week, the Heat sold out both games for the first time in their history. Why? The Moose are the AHL affiliate for the Vancouver Canucks. The crowd was almost entirely pro-Moose.

The Iowa Stars, the Iowa Chops, the Edmonton Roadrunners – all AHL teams that folded in the last five years.

The market has been saturated, I believe. It’s time for some of these smaller leagues to start merging and working together. The AHL/IHL merger did wonders for the AHL, and the ECHL has remained fairly strong with the absorption of the WCHL. Precedent is there… it just takes some forward thinking.

I’m invading next weekend. Be prepared.

On those Big 10 helmet ideas, that Indiana helmet with the state outline and “I” actually looks alright. Good improvement.

I hate the team, but I would love to see Penn State modernize with that oval cat logo on the helmet, like Hank suggested above. But helmet numbers would be much worse than the blank whites they have now.

And Iowa would improve by getting away from their Steelers copycats. I don’t like either team, so they need to be different!

The Illinois headdress helmet looks ok, but probably wouldn’t be allowed. At least we know what that one looks like now.

The rest of the prototype helmets didn’t look as good as the current ones, so I didn’t like them. The Northwestern one was the worst though. Their N logo is great.

New ideas are interesting to check out, good or bad. We all have our opinions, and those are mine.

for all those arguing that if their NFL team up and moved to another league their fans would follow to this new league perhaps we should remember the last strike when replacement players played … and attendance fell on its face most places.

there is something to the NFL brand. like it or not, it signifies the highest level of football in the world.

if Jerry picks up the Cowboys and plops them into the CFL (there will be rejoicing in Canada and in Philadelphia) but it’s not going to be the same and we all know it and his franchise will lose value.

am I a fan of the NFL? well, sorta. I will watch all the playoff games this weekend, not just the Cowboys-Vikes game. but I am more of a Cowboys fan than an NFL fan.

but I wouldn’t disagree that the Cowboys need the league. and I don’t mind them wearing the NFL shield (in whatever form). what I hate is the endless corporate logos on everything. IT’S NOT NASCAR!!!

I’m not going to get into the legal issues… I’ve had that argument too many times on other sites and it never really goes anywhere…

But I will say that the apparent sameness of modern uniforms and logos has nothing to do with Reebok. Pat the Patriot and the old Broncos D were both replaced by streamlined logos long before the NFL was using an exclusive uniform supplier. The blame falls on modern design trends and computerized artwork. For good or bad, the hand-drawn logo is dead.

The one germ of truth in the NFL lawyer’s argument & the one hole in Paul’s is that there is technically no game for an NFL team to play if the league doesn’t exist, since the NFL has essentially created pro football as it is over time through the codification of its rules. In fact, only two NFL teams predate the formation of the league (Cardinals & Packers). It might be more reasonable to view the NFL’s relationship to its teams as akin to FIFA’s relationship to international soccer teams. Which means, ideally, that of a distant regulatory body rather than an intrusive corporate meddler.

But I think what I’d like best is gray with a scarlet block “O,” and lose the stickers.

While I see what you’re saying in your argument about fans rooting for teams and not leagues, it is the leagues that give those teams value. However, if my beloved Ravens played in the Arena League, I really don’t think I would care about them as much. I’ll be quite honest, I not only did not watch a single UFL game, I can’t even name any of their teams. The Dallas Cowboys have incredble brand identity and loyalty, but they are given credibility by their association with the NFL. If the broke off and joined the UFL, how many of their millions of fans would be left in 3 years?

The talk about common templates in sports uniforms reminds me a little of the demise of character in NASCAR. Once upon a time, you had multiple manufactures (chevy, ford, pontiac, buick, olds) racing and the cars actually somewhat resembled the car that was on the road. Hence the old adage “win on Sunday, sell on Monday”.

Somewhere in the mid 90s, the body types of the cars started to get very similar looking, even with chevy, ford and pontiac all being involved.

Now, you have this car of tomorrow which is a box on wheels and even though with toyota you have four different makers, the cars look exactly the same, it’s the engine under the hood that’s different.

That’s a bit of an apples/oranges comparison, though.

Relegation isn’t a one-way process. There’s also promotion that goes along with it. So, using your example, if Newcastle United gets relegated at the end of the season, there’s still a chance that it’ll get promoted back to the EPL the following year.

    1. Where the the photographer? If you take a straight on photo of a mirror, you generally end up in the middle of that image.

    2. Based on the reflection, it appears a play is about to be run, if not a snap taking place at that very moment. What would a photographer be doing out on the field at that point in the action?

    3. How would a player react to having a photographer blocking his view of the middle of the field as a play is beginning? I\’m guessing the camera wouldn\’t be treated too kindly.
While I see what you’re saying in your argument about fans rooting for teams and not leagues, it is the leagues that give those teams value. You’re right, I only ever buy Baltimore Ravens merchandise. I don’t think I’ve ever bought an NFL logo t-shirt. If the broke off and joined the UFL, how many of their millions of fans would be left in 3 years?
but if the Bears, packers, patriots, redskins, and cowboys left the NFL made a new league and had 5 new teams in it would you then abandon them? I’d guess not you say that sounds like a good upstart league that has teams that know whats going on with football. Saying if they went the the AFL isn’t the same that’s a different sport.

Because he was bordering on incompetent back then.

Imagine the awareness and positive community “goodwill” that could be generated … by just playing along. He was gift-wrapped a quirky promotion campaign, whether or not the team had ANY interest in changing helmets. He had a big fan who cared enough to do something fun!

Okay looking at the new google map I feel dumb for even asking the question. But I swear, the picture must have just been updated today, because yesterday they had a different one. In the picture yesterday, there was no sign of football lines, different shade of grass, or bleachers.

I mentioned in comments last week that I was working on an article about abbreviated city names on uniforms. Click on the link attached to my name on this post if you want to check it out.

I have two uniform white whales and I have seen them with my own two eyes.

One is in Indianapolis and the other is from Japan.

The one in Indianapolis is in the Conseco Fieldhouse, it is a picture of the Pacers after the Flo Jo design from the early 1990s, but would have changed the team colors to blue, light blue and yellow. I saw it in the history of Indiana basketball, primarily about the Pacers. I didn’t take a photo, but it never made it onto the court. It is one of the few examples of a mock-up for an NBA team that didn’t get thrown in the trash bin.

As for the one in Japan, it is a complete volleyball uniform from Issey Miyake in 1991 from the Japanese men’s volleyball team. Completely black and orange pattern, front, back, shirts, shorts, kneepads and socks. Just bizarre and pre-internet. I saw it during the 1991 World League on Sportschannel USA and have been looking for it ever since.

On the Big Televen makeover’s, here is the one I would like to see:

The official Indiana colors are Crimson and Cream. So, dump the white and go to cream? Be a trendsetter in football much like the new trend in baseball is “retro” cream unis. I think cream colored hoops unis would be cool and unique, and cream helemts with crimson and cream unis would be pretty cool.

Not a big fan of any of the proposed helmets, though I think the Penn State one would be fine. I also was surprised I did not completely hate the Michigan flip flop.

The Gopher unis however…different story. Not as bad as the EKG unis from a few years back but what a mess currently.
Herewith a guess, partially based on fact: California v. Southern Cal (the latter in the dark jerseys with striped sleeves) in the late 1930s or early 1940s ….
Cal actually wore those sleeves into the early 1960’s. I saw a College Football preseason annual with Craig Morton on the cover wearing that type jersey, with action photos showing him wearing those stripes.

FWIW, I was one of the 50 members of the general public admitted to see the arguement after standing outside in the cold for four hours. The line was surprisingly short (only about 150-ish total) for such a big case, but they only let in 50 of us because so many seats had been reserved (presumably by media and persons connected with the case–these seats were so hard to come by that there were even about a half dozen or so lawyers that worked on the case in the general public line!)

The crowd was mostly law students/lawyers that were also sports fans. A lot of folks came in NFL-team branded hats and such, but logo clothing isn’t allowed inside. (I thought about wearing some pre-reebok branded apparel before I read the rules).

In line they handed us tickets to reserve our spots (they we’re technically tickets, just placeholders actually.) Very low rent. Just photocopied cardstock with justice clip art and a box for a number to be written. (That image was taken from elsewhere on the web. mine was a purple card with “18” handwritten in black sharpie). There is something refreshingly democratic about the fact that tickets to the supreme court are lower tech than your average high school football game.

The hearing was epic–the justices were much more lively than usual. The only justice that didn’t ask a question was Thomas (typically silent). The rest grilled pretty hard, especially Breyer, Scalia, and Sotomayor. Just to highlight two moments that stood out to me:

This hilarious exchange between (noted Red Sox fan) Justice Breyer and American Needle’s counsel:

BREYER: I’m asking a question, And I just heard you say that you want, for example, you want the Patriots to sell T-shirts in competition with the Saints, or whoever. The Red Sox. All right, You see the point? The Red Sox – I know baseball better. You want the Red Sox to compete in selling T-shirts with the Yankees; is that right?
NAGAR: The ability to compete, Yes.
BREYER: I don’t know a Red Sox fan who would take a Yankees sweatshirt if you gave it away.
NAGAR: In part. But you’ve got to recognize what the competition is for. The competition is for fans. And the fact of the matter is, you’re right that someone who has lived in New York City for a long time is unlikely to be a Red Sox fan and be easily be persuaded to be a Red Sox fan, but the person who is three years old can easily be persuaded.
BREYER: They have very small allowances at three years old.

And finally, the best moment in the case was a rare courtroom-movie kind of gotcha moment between Justice Scalia and the NFL’s counsel:

SCALIA: So does that mean they [the NFL owners] can agree to fix the price at which their franchises will be sold, by concerted agreement, because after all, they are worthless apart from the NFL?
LEVY: Could they agree on prices for their franchises to be sold? Yes, I assume they could agree because they are not independent sources of economic power.
SCALIA: I thought I was reducing it to the absurd!

After a dramatic pause, the courtroom erupted with laughter and Scalia vaporized him with a death-glare. Awesome.

This moment was really telling because it revealed just how much power the NFL is asking for from the courts. The idea that 32 separate owners of anything could agree to fix a price is the very definition of collusion and anti-competitive behavior.

What is plainly faulty about the NFL’s argument is the claim that they only sell merchandise to promote teams. If that was true, they wouldn’t be bothering with an exclusive deal or promoting their merchandise during games. Scalia dismissed this pretty quickly.

Breyer’s assumption that the teams don’t compete for merchandise is also simplistic: there are fans that collect jerseys, or wear jersey’s of multiple teams. The shirt competition is especially relevant in between markets where the two teams don’t have a specific rivalry–like Maryland-DC-Virginia, where it isn’t uncommon to find fans (such as myself) rooting for both the Nats and the Orioles, or the ‘Skins and the Ravens and buying apparel for both.

    ….
Thanks for the analysis – very interesting.

Let me ask you about this one point though – isn’t the very point of the NFL’s case that they aren’t 32 separate owners, that its a single entity and thus incapable of collusion (one entity can’t collude with itself).

If you make the leap that the NFL is a single entity, then the issue Scalia raises and Levy’s response actually make sense.

Actually, he should be called Ahab; Ishmael was the novel’s narrator, not the captain who was pursuing the whale.
while that is true, (i considered referring to paul as ahab) but he perished

if we refer to him as ishmael…he will forever be able to relate the many white whale chasing stories we have out there, as did ishmael recount ahab’s story

Last night the NBA’s Heat and Warriors went color vs. color:

Wonder how the folks who live in Oakland, watching a game in Oakland, liked that the Warriors’ throwback jerseys had “San Francisco” on them.

If they were going to throw back, how about with these? link
    Or Paul’s favorite? link

The bottom two are my two favorite basketball uniforms of all time.

There’s a classic moment at halftime where Commissioner Joe Foss honors the players of the year and Len Dawson has to be out there on the field to receive a car or something – at halftime of the championship game of the league!
As long as Lenny had the Chiefs matriculating down the field before and after halftime, what’s all the hullabaloo?

    link
possibly, but this game is played 7 years before Lenny stated ‘matriculating’ down the field.

Indiana wore cream monochome on the road (with crimson helmets) under Sam Wyche.
    Looked like buttermilk.
Or maybe walking toaster waffles (pre-toasting).
    Not good.

(Speaking of white whales…color photos of that uni are extremely tough to find. I’ve googled for them several times. Zip.)

No offense to ricko (God knows I love him) or everyone that posts here—how else can I completely tie up my day???

But I ‘m starting to think that the ‘white whale’ reference may be getting close to ‘jumping the shark’. :)

granted, this is a road uni and it wasn’t worn in texas, but how is that different if the rangers were to throwback to washington senators in texas?

would the texas fans be pissed?

i seriously doubt the fans in oakland mind the throwback with “san francisco” on the jersey

Unknown teams, but Paul’s gotta love those sleeves:

    link

Herewith a guess, partially based on fact: California v. Southern Cal (the latter in the dark jerseys with striped sleeves) in the late 1930s or early 1940s ….
Cal actually wore those sleeves into the early 1960’s. I saw a College Football preseason annual with Craig Morton on the cover wearing that type jersey, with action photos showing him wearing those stripes.
They sure did. I’ve posted this here before…

    This, too…

wow…. great sleeve stripes!!! I’d also wear that uniform, if i may borrow a phrase. Alsoo mildly disconcerting to see a younger and definitely more nimble Craig Morton… I just remember him as the Giant’s QB that got sacked 85 times in one year!!!!

One more on Morton…. has anyone seen him alive after that sack by Randy White in the SuperBowl ?

When looking for Robin Yount cards on ebay, i stumbled across these:

These are newer cards that just came out, but have really cool old All-Star patches. Some are REALLY ool.

Hey, I’m only riding that whale today, seeing as we’re entertaining nominees for a new one.

Of course the downside is, “Ahab will beckon, and all save one will follow.”

I wonder how many of the fans in attendance even live in Oakland.

For that matter, I wonder how many San Franciscans were there.

Not saying they’re mad about it, just curious how they felt. Maybe I just brought it up because I found them a little too bland compared to the other throwbacks.

Why would they care? It’s a Bay Area team, has been marketed as such for decades. That’s why “Golden State”. I know visiting teams stay at the Ritz-Carlton in San Francisco…at least they did during Thanksgiving week of ’04, because the Hornets (think it was the Hornets, anyway) were on the same floor we were.

The bubblegum Falcon helmet from 1991 has stripes.
    Sorry if it was stated.

Mich. St. patch=Erik and Parrish Makin…
My apologies for that one too.

What is the meaning behind the recent influx of football players (both pro and college) doing a gesture where it appears they are scooping food into their mouths with an imaginary spoon?

Does anyone even know what I’m talking about?
Yes. I saw Ronnie Brown do it at a Fins game i went to this year. It’s either:

    a) I’m eating up yardage/the defense
    b) or it signifies something seen in a music video on MTV/BET or the WWE. I stopped watching music video TV, and wrestling about 6 years ago so I dont know what ‘gestures’..if any, are popular.

I think it’s more A than B. Manly of these players are like kids….they’ll see something on TV and they’ll do it once the spotlight is on them after a big play.

Example: Rocafella Records “Dynasty” or “ROC” hand signal.

Very good observation in regard to fan attachment – it’s the interaction of people and the individual teams, not the league, that drives pro football’s popularity. Personally, I don’t even like the NFL – I like football, but not the league itself. I’m almost hoping for no football in 2011 so that the NFL learns that life can go on without them.

Check out the logo on Adrian Peterson’s shirt in the video at the bottom. Interesting play on the Superman motif! link
